Este trabalho analisa a Administração Pública e o poder regulamentar das agências reguladoras no Brasil, a partir da Constituição de 1988. Utilizam-se a pesquisa bibliográfica e o método dedutivo. Constata-se que essas agências foram criadas, no Brasil, em um contexto de transformação do Estado, que buscava afastar-se da intervenção direta na ordem econômica e adotar um modelo gerencial, focado mais na fiscalização e regulação dos serviços públicos, do que em sua prestação direta. Os resultados indicam que os limites do poder (...) regulamentar dessas agências, entretanto, é objeto de controvérsia, face aos limites decorrentes do princípio da legalidade. (shrink)

Um estudo filosófico do tempo é possível a partir da pergunta pela singularidade do tempo. Nesse sentido, John Sallis, em seu artigo “Another time”, apresenta Heidegger como aquele que forçou a pergunta pelo tempo em termos de uma possível singularidade. Heidegger, em sua obra O conceito de tempo, aludindo a Agostinho recoloca a questão do tempo a partir do Dasein, identificando-os. Contudo, é na ntenção primeira de Ser e tempo, isto é, intentando-se uma compreensão para Temporalität, o sentido do ser, (...) conceito este não concretizado neste tratado, é que se torna possível problematizar a singularidade do tempo. Para tanto, apresenta- se uma compreensão de Sallis da Temporalität como outro tempo. Em contraposição, pode-se pensá-la de modo imanente à temporalidade do Dasein na sua ocorrência do tempo da ocupação, isto é, do tempo presente ontologicamente compreendido. O tempo de ocupação é pensado por Heidegger como abertura ao mundo que tem seu sentido na autocompreensão enquanto cura. É na compreensão do modo do abrir-se da abertura ontológica que se pensa um tempo enquanto tal. (shrink)

Automated classification of legal documents has been the subject of extensive research in recent years. However, this is still a challenging task for long documents, since it is difficult for a model to identify the most relevant information for classification. In this paper, we propose a two-stage supervised learning approach for the classification of petitions, a type of legal document that requests a court order. The proposed approach is based on a word-level encoder–decoder Seq2Seq deep neural network, such as a (...) Bidirectional Long Short-Term Memory (BiLSTM) or a Bidirectional Encoder Representations from Transformers (BERT) model, and a document-level Support Vector Machine classifier. To address the challenges posed by the lengthy legal documents, the approach introduces a human-in-the-loop approach, whose task is to localize and tag relevant segments of text in the word-level training part, which dramatically reduces the dimension of the document classifier input vector. We performed experiments to validate our approach using a real-world dataset comprised of 270 intermediate petitions, which were carefully annotated by specialists from the 15th civil unit of the State of Alagoas, Brazil. Our results revealed that both BiLSTM and BERT-Convolutional Neural Networks variants achieved an accuracy of up to 95.49%, and also outperformed baseline classifiers based on the Term Frequency–Inverse Document Frequency test vectorizer. The proposed approach is currently being utilized to automate the aforementioned justice unit, thereby increasing its efficiency in handling repetitive tasks. (shrink)

O presente artigo objetiva, ao revisitar a obra Oratio de hominis dignitate composta pelo humanista renascentista Giovanni Pico Della Mirandola, um duplo intento: sustentar que as noções de dignidade e liberdade, presentes nessa obra, se distanciam do pensamento cristão tradicional, de modo crítico, justamente porque derivam de uma leitura filosófica da teologia cristã da criação; e mostrar que a conclusão a respeito da noção de liberdade apresentada por Sartre no pensamento contemporâneo pode ser encontrada de modo germinal, guardada as devidas (...) proporções, na leitura piquiana da criação. Para tanto, exporemos uma breve retomada do contexto histórico-filosófico que permitiu ao filósofo engendrar a Oratio bem como suas pretensões para com essa obra; falaremos, em um segundo momento, como o platonismo religioso de Marsílio Ficino, principal matriz teórica a partir do qual os conceitos de dignidade e de liberdade foram modulados, foi recebido e desenvolvido no pensamento de Pico; e como as influências e as rupturas com pensamento de Ficino e a leitura filosófica da teologia cristã da criação são importantes para recolocar os conceitos de dignidade e de liberdade, permitindo assim entrever, por meio deles, semelhanças com o pensamento satreano. O presente artigo é uma discussão sobre a noção heideggeriana de Überwindung. Seu objetivo é duplo: por um lado, [1] mostrar a perspectiva que tal termo deve ser compreendido; por outro, [2] aprofundar esta perspectiva à luz de comentários ao aforismo I do texto Überwindung der Metaphysik. Para tanto, duas questões são postas: em que perspectiva e que questões estão implícitas quando Heidegger propõe o projeto da Überwindung der Metaphysik?; e por que uma Überwindung contém em si tantos problemas? De (...) modo a discutir e comentar tais questões, o artigo percorre dois caminhos: [1] faz-se uma análise da própria indicação heideggeriana da perspectiva de compreensão da Überwindung der Metaphysik, qual seja, revisitar, a partir de um olhar determinado, a construção da noção de história do ser. Esta, por sua vez, tem sua gênese antes mesmo da própria Kehre. Mais especificadamente, na reinterpretação que o próprio Heidegger faz de seu texto Vom Wesen der Wahrheit. A partir desta reconsideração feita por Heidegger e inserida em seu próprio texto, é possível detectar quatro teses fulcrais que traçam essencialmente a metafísica e que justificam a sua superação. São elas: [a] o fato de o ser, originariamente, se velar e provocar, historialmente, o seu esquecimento; [b] a relação entre a verdade do ser e a história, que se desenvolve como história do ser; [c] a ideia de que pertence ao ser um caráter originário de retração de si mesmo e que essa retração é um destino que pertence à história do pensamento metafísico e se configura na própria essência da metafísica; [d] afirmar que a certeza da manifestação da essência coincide com o seu fim. [2] Adentra-se, mediante uma aproximação pari passu, no aforismo I do texto Überwindung der Metaphysik, com intuito de comentar a problematicidade do termo Überwindung quando usado para repensar a metafísica à luz da perspectiva da história do ser. BackgroundFor a long time, in sports, researchers have tried to understand an expert by comparing them with novices, raising the doubts if the visual search characteristics distinguish experts from novices. Therefore, the aim of the present study was to review and conduct a meta-analysis to evaluate the differences in visual search behavior between experts and novices in team sports athletes.MethodsThis systematic review with meta-analysis followed the PRISMA 2020 and Cochrane's guidelines. Healthy team athletes were included, which engaged in regular practice, (...) from any sex or competitive level, specifically classified a priori as expert or novice in the original research. We considered only research published in peer-reviewed journals, with no limitations regarding date or language. It was considered healthy team sport athletes engaged in regular practice. The scenarios could be in situ or film-based. The databases of EBSCO, PubMed, Scopus, SPORTDiscus, and Web of Science were used to perform the searches. The risk of bias was calculated through the RoBANS tool.ResultsFrom a total of 6,257 records, of which 985 were duplicates, titles and abstracts of 5,272 were screened, and 45 required full-text analysis. Of those, 23 were excluded due to not fulfilling the eligibility criteria regarding participants. In the end, 22 studies were selected, however, as two studies were part of the same trial and were analyzed conjointly.DiscussionExperts showed to be older and with more years of practice. The ability to distinguish experts from novices was not so clear regarding the variables analyzed. This could be due to the strategies chosen in each study, which were specific to each scenario, and when grouping all together, it was lost information within non-representative averages. The distinction between experts and novices was not clear, showing a lot of heterogeneity in the included studies. The expert classification itself may have been the conditioning aspect for these results, retaining the doubt and the need for more studies in the field.Systematic review registrationThe protocol was pre-registered in OSF. A potencialidade na filosofia da educação antiga e medieval 1 Resumo: O texto aborda a potencialidade, na filosofia da educação antiga e medieval, como a capacidade de aperfeiçoamento da razão. A noção de paideia conduz essa reflexão, uma vez que perpassa o pensamento educacional desde a antiguidade clássica até a baixa Idade Média. Essa continuidade explicita a tradição da formação integral do homem que considerava os aspectos morais e políticos como uma totalidade indissociável. O encaminhamento teórico segue a concepção de (...) História Social de Braudel (1902-1985), já que o foco é a compreensão da herança teológica e filosófica, que exprime os fundamentos da educação. Para refletir sobre esse legado do conhecimento, três momentos foram estudados: a paideia grega na perspectiva aristotélica e platônica; a patrística, por meio do entendimento de Clemente de Alexandria (150-215 d.C.) e de Agostinho de Hipona (354-430 d.C.); e a escolástica, analisada nas concepções de Hugo de São Vítor (1096-1141) e Tomás de Aquino (1225-1274). Assim, nos autores apresentados, há a permanência da compreensão de que o aperfeiçoamento da razão significava a transformação em ato da potência essencial do homem: a razão. A principal finalidade da educação, portanto, era a formação da consciência de cada pessoa, pois entendia-se que esse era o principal meio para o êxito da vida em comum. Potentiality in the philosophy of ancient and medieval education Abstract: The text addresses the potentiality, in the philosophy of ancient and medieval education, as the ability to improve reason. The notion of paideia guides this reflection since it pervades educational thought from classical antiquity to the low Middle Ages. This continuity explains the tradition of the integral formation of man which considered the moral and political aspects as an inseparable totality. The theoretical approach follows Braudel’s conception of Social History since the focus is on understanding the theological and philosophical heritage, which expresses the fundamentals of education. To reflect on this legacy of knowledge, three periods were studied: the Greek paideia in the Aristotelian and Platonic perspective; patristic, through the understanding of Clement of Alexandria and Augustine of Hippo; and scholasticism, analysed in the conceptions of Hugh of Saint Victor and Thomas Aquinas. Thus, there is a continuing understanding in the authors presented that the improvement of reason meant the actualization of man's essential potency: reason. The main purpose of education was the formation of the conscience of each person, as it was understood that this was the main means for the success of life in common. Por lo tanto, existe un entendimiento continuo en los autores presentados de que la mejora de la razón significó la actualización de lo potencial del hombre: la razón. Neste artigo, ponderamos sobre a concepção educativa de Hugo de São Vítor exposta em sua obra pedagógica _Didascalicon de Studio Legendi _e temos como objetivo compreender o uso da leitura como meio de desenvolvimento do intelecto humano._ _Situados em um período de mudanças importantes para o ocidente medieval, os escritos do autor indicam, aos seus discípulos, os elementos fundamentais para se conquistar o bom estudo. Baseando-nos no conceito de longa duração, examinamos, neste trabalho, alguns aspectos educacionais-sociais importantes para a (...) formação humana contemporânea, já que a História Social nos faz compreender que presente e passado se interligam por meio de características que nos tornam humanos: a memória e os comportamentos que geram civilidade. Em nossa análise do texto, observamos que a _Sapientia_ é considerada, para o autor, como a meta principal da jornada de um estudante e, para ser possível alcançá-la, é necessário que se faça o uso adequado da Filosofia e da Ciência. Essas, por sua vez, quando amparadas pela memória, poderiam proporcionar redução do embrutecimento existente na sociedade e exercitar a amizade do ser humano com seu Criador. A escolha de um bom método de estudo e o uso da vontade também marcam esta concepção educativa medieval, que se destacou por promover a transição do modo de leitura monástico para o escolástico. _Didascalicon_ também é conhecido como um texto que transcendeu a cópia de conteúdo –– prática comum à época –– no qual seu autor expressa, de forma escrita, suas ideias (embebidas de influências agostinianas), e que busca instruir àqueles que procuram o caminho para alcançar a _Sapientia_ –– na qual habita a forma do bem perfeito. Nestes artigos da Nação Portuguesa é perceptível um pendor mais prático que surge com maior clareza no princípio da série seguinte, na qual o periódico é seccionado em duas partes distintas, já claramente perceptíveis nesta segunda leva: a primeira, onde se inserem os estudos de momentânea curiosidade, feitos de crónica, transcrições, referências à revista, etc.; a subsequente, onde se podem encontrar os ensaios de crítica, filosofia, história e ciência, “em que os altos problemas do espírito vão sendo discutidos”. Por esse (...) motivo, foi desta última secção que nos ocupámos, tentando traçar as linhas gerais dos textos de António Sardinha, Pequito Rebelo, Rolão Preto, Afonso Lucas, Francisco Veloso, Rodrigues Cavalheiro e Avelino Soares. Também caracterizamos validadesuniversais e existenciais em termos de tautologias.

O objetivo deste artigo é apontar cinco aspectos do pensamento nietzschiano que podem ser relevantes para os debates da filosofia da ciência em torno da natureza e representação do conhecimento científico. Para tanto, é realizada uma revisão de literatura com o objetivo de selecionar trechos de obras nietzschianas como O nascimento da tragédia, Genealogia da moral, A gaia ciência e outras que permitam interpretar Nietzsche como um filósofo da ciência preocupado com a construção do conhecimento cientifico sobre a realidade física. Como resultado é possível identificar uma proposta epistemológica na perspectiva nietzschiana, cuja representação objetiva do mundo deve apontar para uma estética da vida. -/- The purpose of this article is to point out five aspects of Nietzschean thought that may be relevant to debates in the philosophy of science around the nature and representation of scientific knowledge. To this end, a literature review is carried out with the aim of selecting excerpts from Nietzschean works such as The Birth of Tragedy, Genealogy of Morals, The Gay Science and others that allow us to interpret Nietzsche as a philosopher of science concerned with the construction of scientific knowledge about the physical reality. As a result, it is possible to identify an epistemological proposal in the Nietzschean perspective, whose objective representation of the world should point to an aesthetics of life. (shrink)

What I call the Doxastic Puzzle, is the impression that while each of these claims seems true, at least one of them must be false: (a) Claims of the form ‘S ought to have doxastic attitude D towards p at t’ are sometimes true at t, (b) If Φ-ing at t is not within S’s effective control at t, then it is false, at t, that ‘S ought to Φ at t’, (c) For all S, p, and t, having doxastic (...) attitude D towards p at t is not within S’s effective control at t. All three natural replies to the puzzle have been pursued. Some have claimed that doxastic attitudes like believing that p are, in fact, within our effective control, or sufficiently so. Others have claimed that doxastic ought-claims, strictly speaking, are always false. And some have denied that effective control is required for the adequacy of doxastic ought-claims in general. I here pursue and examine a different strategy. In the first part of this paper, I argue that these claims are not only each true but actually not in tension with each other in the first place. Instead of attempting to dispel the puzzle, this solution proposes to evade it instead: to solve it by properly understanding, and by thereby accepting without contradiction, all of its constitutive claims. In the second part of the paper, I argue that the evasive strategy forces us to re-think our understanding of the place of normative reasons in epistemology. More exactly, it seems to come at the cost of one central way of thinking about our reasons for having doxastic attitudes, one where such reasons are good-standing exemplars of normative reasons in general. The evasive strategy, that is, threatens to lead us very quickly to a deflationary picture of epistemic normativity: it rescues normative talk, but sacrifices normative substance. I conclude by explaining why I think this is more consequential than some have made it out to be, and by suggesting that these consequences are welcome nonetheless. (shrink)

My starting point is what I call the Normative Authority Conception of justification, where S is justified in their belief that p at t (to some degree n) if and only if their believing that p at t is not ruled out by epistemic norms that have normative authority over S at t. With this in mind, this paper develops an account of doxastic justification by first developing an account of the normative authority of epistemic norms. Drawing from work in (...) political philosophy, I argue that (a) the cognitive and evaluative commitments and concerns behind our actual practices of holding each other and ourselves accountable for our beliefs reveal which epistemic norms we have consented to be under, and that (b) it is because we have consented to be under the authority of these norms – by actually holding ourselves and others accountable to them – that they in turn have normative authority over us. By connecting the authority of epistemic norms to the authority we have over ourselves in this way, the resulting account of doxastic justification (i) explains why it can be appropriate to criticize, resent, or sanction someone for having unjustified beliefs, (ii) avoids the phenomena of normative alienation and normative parochialism, and (iii) respects the social and collective nature of epistemic justification. The question of the function of reasoning is drawing increased attention. One suggestion is that the function of reasoning is argumentative: to find arguments to convince others and to evaluate others’ arguments. Darmstadter offers an alternative. According to this pragmatic theory the function of reasoning is to minimally adjust our beliefs so that they remain sound guides for action. This theory is similar to the classical view, which sees reasoning as a way of improving the reasoner's beliefs and decisions. The (...) pragmatic theory shares the classical view's flaws as a theory of the function of reasoning: it does not define reasoning strictly enough, it does not offer a convincing evolutionary rationale for reasoning's existence, it does not make predictions based on this rationale, and it does not properly test these predictions. Darmstadter also points out the importance of the phenomenon of deliberation failures. While I argue that documented deliberation failures are compatible with the argumentative theory of reasoning, Darmstadter's work usefully draws attention to the importance of studying reasoning outside the laboratory and in particular in argumentative situations. This collection of essays examines the ways in which disputes and controversies about the application of scientific knowledge are resolved. Four concrete examples of public controversy are considered in detail: the efficacy of Laetrile, the classification of homosexuality as a disease, the setting of safety standards in the workplace, and the utility of nuclear energy as a source of power. The essays in this volume show that debates about these cases are not confined to matters of empirical fact. Rather, as (...) is seen with most scientific and technical controversies, they focus on and are structured by complex ethical, economic, and political interests. Drs. Engelhardt and Caplan have brought together a distinguished group of scholars from the sciences and humanities, who sketch a theory of scientific controversy and attempt to provide recommendations about the ways in which both scientists and the public ought to seek more informed resolutions of highly contentious issues in science and technology. By placing John Dewey between John Rawls and Richard Bernstein, I argue for a socialist reading of Dewey’s takes on liberal democracy that moves away both from conservative readings of Dewey of those who claim that his democratic liberalism actually belongs to right-wing or center views, and from left-wing, communitarians who dismiss such views as irrelevant for socialist and radical variants of liberal democracy. Overall, it can be shown that Rawls and Dewey’s different takes on political liberalism could be ultimately (...) reconciled, given their similar takes on democracy, pluralism, and the person. Rawls’ rehabilitation of Kant can itself be shown to be closely related to his reading of Dewey. Furthermore, as Bernstein argues, such a renewal of Dewey’s social and political philosophy in Rawls’s political constructivism and reflective equilibrium was decisive for the great pragmatist turn observed in the second, third, and fourth generations of critical theory, not only in the so-called Frankfurt School (especially Habermas, Honneth, Forst) but also in feminist and decolonial thinkers such as Nancy Fraser, Seyla Benhabib, Judith Butler, Rahel Jaeggi, and Amy Allen. Dewey’s pragmatist turn in political philosophy allows thus for a dynamic, robust correlation between radical democracy and public education, which could be implemented in emerging democracies like Brazil. The objective of this work is to present Ludwig Wittgenstein's perspective on the impossibility of the existence of philosophical problems, to then reflect on the implications of such a perspective based on Popper's thought. For that, Wittgenstein's perspective, as exposed in his work Tractatus logico-philosophicus, is contrasted with Karl Popper's perspective presented in “The nature of philosophical problems and their scientific roots” (in Conjectures and refutations). The example of the problem faced by Kant in his work Critique of pure reason (...) will also be considered for the analysis of Wittgenstein's argument. According to Wittgenstein, philosophical problems are pseudo-problems because they have no solution. However, despite admitting the existence of pseudo-problems, Popper argues that factual, logical, or hybrid problems, under certain circumstances, can be philosophical. Thus, the aim is to contrast these two perspectives in order to emphasize how not all philosophical problems are pseudo-problems. (shrink)

Um alinhamento responsável à alguma versão do naturalismo filosófico requer a articulação explicita e cuidadosa de um argumento em sua defesa. Em quatro passos, o texto que segue abaixo expande e examina a validade de um argumento que é frequentemente rascunhado em favor do naturalismo. Como veremos, contudo, a versão do naturalismo que esse argumento nos permite é um pouco diferente dos naturalismos filosóficos mais populares.

The objective of this work is to reflect on the usual and the unusual, based on Friedrich Nietzsche's perspective on the opposition between the pathos of distance or nobility and the ethos from the point of view of utility. In order to do so, an analysis of selected excerpts from Nietzsche's works is carried out, mainly On the genealogy of morality and Beyond Good and Evil. According to Nietzsche, there is no ethos, but only pathos, being the ethos, affirmed by (...) asceticism, only a strategy, a cunning and deceitful invention for the conservation of a precarious way of life. It is this ethos that forges and fixes ascetic values that represent the usual, by inverting values from the point of view of the resentful human's utility. Based on this Nietzschean perspective, we seek to reflect on the unusual as an active impulse that characterizes the noble-type pathos of distance, and the usual as a reactive impulse that characterizes the éthos from the point of view of utility. This essay offers a fresh interpretation of Bhartr̥hari’s concept of “insight”, and of its identification as the object of a sentence in the second kāṇḍa of the Vākyapadīya. Earlier scholars dealing with this topic disagreed on three main points: whether an epistemologically rigorous concept of insight can be found in Bhartr̥hari’s work, or if the notion remains irrevocably vague and equivocal; whether the concept of pratibhā primarily belongs to linguistics, or to action theory; whether Bhartr̥hari’s identification of insight as the (...) object of a sentence should be taken literally or figuratively. Starting from a close analysis of all passages in Bhartr̥hari’s work mentioning pratibhā, I identify, first of all, a univocal understanding of insight, valid throughout the Vākyapadīya, as immediate cognition informed by verbal transmission, in other words as a form of practical knowledge, non-representational yet essentially productive and dynamic. Showing, on this basis, how Bhartr̥hari’s understanding of language at the level of sentences is pragmatic rather than referential, I demonstrate, against the view prevalent in the late grammatical tradition, that a literal interpretation of his provocative statement on pratibhā as vākyārtha remains perfectly plausible. This thesis is further corroborated by the consideration of post-Bhartr̥hari philosophical sources elaborating on his ideas, which allow us better to understand in what sense pratibhā can legitimately be thought of as cognition “without an object”. The Belnap–Dunn logic is a well-known and well-studied four-valued logic, but until recently little has been known about its extensions, i.e. stronger logics in the same language, called super-Belnap logics here. We give an overview of several results on these logics which have been proved in recent works by Přenosil and Rivieccio. We present Hilbert-style axiomatizations, describe reduced matrix models, and give a description of the lattice of super-Belnap logics and its connections with graph theory. We adopt the point of (...) view ofAlgebraic Logic, exploring applications of the general theory of algebraization of logics to the super-Belnap family. In this respect we establish a number of new results, including a description of the algebraic counterparts, Leibniz filters, and strong versions of super-Belnap logics, as well as the classification of these logics within the Leibniz and Frege hierarchies. In this provocative study, Bedau demonstrates the usefulness of "casuistry," or "the method of cases" in arriving at moral decisions. He examines well-known cases, including the aftermath of the sinking of the William Brown in 1841, that compel us to consider questions about who ought to survive when not all can. By doing so, we learn something about how we actually reason concerning such life and death situations, as well as about how we ought to reason if we wish both (...) to be consistent and to properly respect human life. This article questions the place of the child in the metaphysics and imaginary of Western colonization, racialization, and decolonization. In the last chapter of The Wretched of the Earth by Frantz Fanon, children appear not only as victims but also as a problem for which Fanon struggles to account as a theorist of decolonization as much as a psychiatric practitioner. Through a reading of one of the cases, this article interrogates the ways in which colonization attempts to infantilize colonized populations (...) while erasing childhood, and the ways in which decolonization meets colonization by regarding childhood in the end as a misfortune. The work of decolonization, to proceed, thus would demand us to rethink childhood, and in doing so break free of Western metaphysics. (shrink)

In Plotinus the myths are scattered throughout the Enneads‟ treatises. In contrast with Porphyry, Plotinus prefers to make allusions and fragmentary quotations of the myths rather than an exegesis of a comprehensive extract of a poem. Only one of Porphyry‟s works, dedicated to the allegorical exegesis of Homer, has come down to us in its integrity: The cave of the Nymphs in the Odyssey. In this work, which is studied here, Porphyry follows a complete extract of Homer in order to (...) find a hidden meaning beneath the letter of the text. Through an analysis of a small sample of the plotinian mythical kaleidoscope and then of Porphyry‟s above-mentioned work, this article intends to show the main characteristics of the mythical exegesis of the epical tradition in both authors.myth, exegesis, image, genealogy, allegory. Given many meanings that the school has adopted for each person, we have found the need to provide some reflections on the subject, supported in a philosophical perspective, in order to enlarge the debate on the values of the school for teachers and students, especially. This brief paper aims to make a cut about the value that the figure of the object "school" has adopted for teachers and students. We refer to the school, involving only the institutions of the levels (...) from elementary to secondary school, not including the institutes or other levels. The work has as scientific foundations philosophical contributions of authors like Herbart, Wittgenstein, MacIntyre, Deleuze, Aristotle, Dewey, Foucault, and orientations coming from the linguistics of Saussure, which supports us in the understanding and management of language. Ainda que sejam muitos os momentos em que o Direito se deixa influenciar pelos valores, existe hoje uma convicção de que os processos de aplicação do Direito resultam de processos racionais. Acredita-se que o aplicador do direito é influenciado pelos argumentos das partes, e constrói sua decisão racionalmente. Todavia, novas descobertas da Neurociência e da Psicologia Moral mostram que muitos desses julgamentos morais, que inevitavelmente influenciam os julgamentos jurídicos, são feitos de forma inconsciente e não-racional. Quando formados, esses julgamentos são (...) imunes a argumentos racionais contrários. Por meio de revisão bibliográfica, discutem-se neste trabalho algumas decorrências dessas novas descobertas para o Direito. Entre elas, a possibilidade de reforçar o treinamento filosófico mais aprofundado no curso de formação de juristas, ou no curso de formação de magistrados, tornando essas pessoas mais permeáveis a argumentos contrários às suas próprias convicções morais. E ainda, a limitação do mandato dos Ministros dos Tribunais Superiores, com o objetivo de evitar que a jurisprudência se atrele à convicção moral de uns poucos juristas por longos períodos de tempo. Resumo: Nossa intenção, neste artigo, é apresentar uma leitura da narrativa hesiódica da criação de Pandora, a primeira mulher, analisando sob quais aspectos aparecem, na poesia arcaica grega, os traços míticos relacionados ao feminino que Simone de Beauvoir mapeia na segunda e na terceira parte do primeiro volume de O Segundo Sexo, intituladas História e Os Mitos. O que de próprio à condição feminina ocidental é atribuído à mulher desde Hesíodo e como? A leitura que faremos segue a estratégia do (...) “releasing” (libertação) de autoras feministas, como Vered Kenaan, em Pandora´s Sense. Trata-se de libertar a imagem da primeira mulher da sua conotação negativa e das consequências opressoras que dela decorrem e mostrar como a narrativa grega sobre a criação de Pandora apresenta traços de ambiguidade e indeterminação próprias à condição humana em geral, conforme Beauvoir apresenta em Por uma moral da ambiguidade, traços que a tradição patriarcal revestiu de fantasias e atribuiu exclusivamente à mulher ou responsabilizou-a por eles. Vale ressaltar que não se trata de descobrir, sob o olhar masculino sobre a mulher, uma verdade mais fundamental, uma natureza do feminino. Mas de, compreendendo a construção da condição feminina de subjugo, encontrar na imagem da mulher,potências que nos permitirão transformá-la. (shrink)
